Terms of Service.

The rules for using HartaFarmacii — the nature of our service, limits of liability and your rights. Written in plain English, without unnecessary legalese.

1. Acceptance of the Terms

These Terms of Service (the “Terms”) govern your access to the hartafarmacii.ro website and to the HartaFarmacii mobile app for iOS (and, once launched, for Android), and your use of any service offered through them (the “Service”). By accessing or using the Service you agree to comply with these Terms in full. If you disagree with any provision, please do not use the Service.

We may update these Terms from time to time — see the dedicated section for how changes are communicated.

2. Description of the Service

HartaFarmacii is an independent price comparison tool for over-the-counter (OTC) medicines, food supplements and dermo-cosmetic products sold by Romanian pharmacies, plus a geographic pharmacy locator built on public OpenStreetMap data. The core Service is offered free of charge, with no registration or user account required.

HartaFarmacii does not sell medicines, does not process payments for pharmaceutical products, does not take orders and is not a party to any commercial transaction between you and a pharmacy. We are not a commercial partner, affiliate or distributor for any of the chains we index. Our role is purely informational: we collect public data and present it through a unified interface.

Displayed prices are indicative, collected automatically from public sources (pharmacy catalogue pages, schema.org Product metadata) and may be a few hours up to 24 hours old. The actual price and stock availability at the till may differ; always confirm directly with the pharmacy before travelling or buying.

3. Account-less service

The Service offers no user accounts. All core features (search, map, filtering, price comparison) are accessible anonymously, both on the web and in the mobile app.

In the mobile app, your favourite pharmacies are stored locally on the device and tied to an anonymous per-device identifier (a UUID generated on first launch and kept in the iOS Keychain). There is no “account” to create or restore on another device. Deleting the app or resetting the identifier from the Settings screen makes the favourites list inaccessible.

4. Acceptable use

By using the Service you agree not to:

  • scrape pages in bulk or automatically (we provide a free public API for that purpose);
  • circumvent rate limiting, anti-abuse measures or other security controls;
  • redistribute our editorial content (texts, guides, original photographs) without proper attribution and a link to the source;
  • use the Service for unlawful, deceptive or bad-faith activity (phishing, fraud, misinformation);
  • tamper with or disrupt the website or app via code injection, DDoS attacks, automated probing, brute force or other offensive techniques;
  • use the mobile app in any way that violates the platform rules (Apple App Store Review Guidelines for iOS, Google Play Developer Program Policies for Android, when launched).

We provide a free public API with reasonable rate limits. For higher volumes or commercial use cases, please contact us in advance.

5. In-app purchases (iOS)

The HartaFarmacii iOS app offers one optional purchase:

  • Product identifier: premium_lifetimeMed
  • Type: non-consumable — bought once per Apple ID;
  • Price: 4.99 RON (or the local equivalent set by Apple for your account region), one-time payment;
  • No auto-renewal: not a subscription, no recurring billing, no trial;
  • Benefit: permanently disables every ad inside the app (banner, interstitial, native);
  • Processing: the transaction is processed exclusively by Apple App Store through StoreKit. We never see your payment card details;
  • Restoration on other devices: the “Restore purchases” button in the Settings screen re-enables the benefit on any iPhone or iPad signed in with the same Apple ID;
  • Refunds: handled exclusively by Apple in line with App Store policy. Submit requests at reportaproblem.apple.com. We cannot issue refunds directly.

This clause implements the disclosure requirements of Apple App Store Review Guideline 3.1.2(a) for non-consumable products.

6. Apple Standard EULA

If you downloaded the HartaFarmacii app via the App Store, your usage licence is, by default, the Apple Standard End User License Agreement (EULA), entered into between you and Apple Inc. at the moment of installation. The full text is at apple.com/legal/internet-services/itunes/dev/stdeula.

Apple's EULA covers matters such as: your limited, non-transferable right to use the app; restrictions on reverse engineering; the fact that Apple is not responsible for the content provided by the app; and that Apple may enforce the terms as a third-party beneficiary. These HartaFarmacii Terms supplement — not replace — Apple's EULA where they do not conflict with it.

7. In-app purchases (Android — future)

Once the HartaFarmacii Android app is available on Google Play, any in-app purchases will be processed exclusively through Google Play Billing. Refunds and transaction support are handled through your Google Play account, in line with Google policy. We will keep functional parity with the iOS version: a single non-consumable purchase that disables ads, with no subscriptions.

8. Ads in the mobile app

The free version of the iOS app shows ads served by Google AdMob (Google Ireland Ltd. / Google LLC). On Android, the same system will be used through Play Services Ads. Ad formats:

  • Banner: a small fixed strip in the interface;
  • Interstitial: a full-screen ad shown sparingly between natural app transitions;
  • Native: an ad blended into the result list, clearly labelled “Sponsored”.

For users in the European Economic Area, the United Kingdom and Switzerland, before showing ads the app displays a Google UMP (User Messaging Platform) consent form, in line with the GDPR. If you decline consent for personalised ads, you will still see ads, but non-personalised (no profiling). You can change this choice at any time from the Info screen → “Ad privacy options”.

Buying premium_lifetimeMed permanently turns off all of these ads.

9. Intellectual property

The original content of HartaFarmacii — interface design, editorial copy, logo, icons, proprietary source code, the Guides articles and derived data structures — is protected by copyright law and belongs to the operator of the Service, © 2026 HartaFarmacii. All rights not expressly granted in these Terms are reserved.

Partial reproduction of our editorial content is allowed if you clearly cite the source (“Source: hartafarmacii.ro”) and link back to the original article. Full or systematic reproduction requires prior written consent.

Third-party data and trademarks remain the property of their owners:

  • OpenStreetMap — geographic data (pharmacy coordinates, addresses, raster maps) is licensed under ODbL and comes from © OpenStreetMap contributors;
  • Pharmacy chain logos and trademarks (Catena, Dr. Max, Help Net, Sensiblu, Farmacia Tei and others) belong to their respective owners and are used purely descriptively, to help users identify the source of a price quickly. This use falls within editorial fair use and does not imply affiliation, sponsorship or endorsement;
  • CANAMED data — the Romanian National Catalogue of Medicine Prices — is published by the Romanian Ministry of Health and reproduced under the legal regime applicable to public information;
  • Apple, App Store, iOS are trademarks of Apple Inc.; Google, Google Play, Android, AdMob are trademarks of Google LLC. Their use in this document is purely descriptive.

If you hold copyright or trademark rights over material published on HartaFarmacii and want it taken down, send a written notice to contact@hartafarmacii.ro. We respond within seven business days and review the request in good faith.

10. Links to external sites

The Service contains links to third-party sites — mainly the indexed online pharmacies, plus public bodies (Ministry of Health, ANM, OpenStreetMap). These links are provided for your convenience and carry no liability for the content, privacy policies or commercial practices of those sites.

Links to online pharmacies carry no affiliate revenue: HartaFarmacii receives no per-click or per-sale commission from any indexed chain.

11. Limitation of liability

The Service is offered “as is” and “as available”, with no express or implied warranty as to accuracy, completeness, reliability or continuity.

Medical and drug information published in the guides and symptom sections is for information only and does not replace consulting an authorised doctor or pharmacist. For diagnosis and treatment always consult a healthcare professional. In a medical emergency call 112.

To the maximum extent permitted by applicable law, HartaFarmacii and its operator are not liable for:

  • medical decisions taken on the basis of website or app information;
  • differences between the displayed price and the actual price at the pharmacy shelf or till;
  • stock unavailability of a product at the chosen pharmacy;
  • temporary unavailability of the Service (maintenance, technical incidents, external attacks);
  • the content, behaviour or policies of third-party sites and apps (online pharmacies, OpenStreetMap, App Store, Google Play, AdMob);
  • indirect, moral, opportunity or profit losses arising from use or inability to use the Service.

12. Changes to the Terms

We may modify these Terms as the Service evolves or the law changes. Substantial changes are announced through a visible banner on the main pages and, in the mobile app, through an informational screen at startup, at least 30 days before they take effect. Minor technical changes (typo fixes, clarifications, rewording) may be published directly, with the date at the top of this document updated accordingly.

Continuing to use the Service after the new Terms take effect is implied acceptance. If you disagree with the changes, your only course of action is to stop using the Service and, optionally, uninstall the app.

13. Governing law and jurisdiction

These Terms are governed by the laws of Romania and, by extension, applicable European Union law. Any dispute is to be settled, in the first instance, amicably through a request sent to contact@hartafarmacii.ro.

Failing an amicable agreement within 30 days, the dispute will be decided by the competent courts of Bucharest, Romania. EU consumers can also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

14. Apple as third-party beneficiary

For the iOS app, you acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you as an end user, to the extent applicable to the app downloaded through the App Store. This clause implements the requirement set out in Schedule 1 of the Apple Developer Program License Agreement.

15. Severability and entire agreement

If any clause in these Terms is held invalid, unlawful or unenforceable by a competent court, the remaining provisions stay in force unaffected. The invalid clause is to be replaced by a valid provision that reflects, as closely as possible, the original economic intent.

These Terms, together with the Privacy Policy and — for iOS users — Apple's EULA, constitute the entire agreement between you and HartaFarmacii in respect of the Service and supersede any prior understanding on the subject.
